20 July 1919: £300 Compensation for Workman's Death - Sheriff Moffatt has given judgment in an action under the Workmen's Compensation Act at the instance of Mrs Margaret Forsyth Penman or Duncan, Meadowview, Carronshore, near Falkirk, on behalf of herself and children, against Carron Company for compensation in respect of the death of her husband, who was killed when in defenders employment in July 1919. The defence was that deceased met his death through riding on a loaded hutch on the haulage road in contravention of the Coal Mines Act, and maintained accordingly that the accident did not arise out of or in the course of deceased's employment with them but was due to a risk which he had added thereto. Sheriff Moffatt finds that deceased met his death in an accident arising out of and in the course of his employment, and that pursuers as dependants of the deceased are entitled to an award of £300 as compensation. [Scotsman 3 April 1920] NB Alexander Duncan, underground fireman age 42, died of injury to head in William Pit, Carronhall Colliery.
