He was crushed between a tram and a arm of a pair of timbers. It appears an empty tram had been tipped up on its side on a wide part of the roadway called a ‘tumbling place’. He had been assisting the colliers to tip up the tram. A loaded tram was pushed down and in passing knocked against the wheels of the tipped up tram. Dumpress was standing by the side of them empty tram and was crushed against the arm of a pair of timbers. He had only worked one month underground and it would not have stood in that position if he had had any experience of the work. The colliers should have warned him of his danger.
