- A fellow workman fired off three shots without authority. He did not attempt to find out if all the men were clear not did he give an effective signal that he was about to fire. Drake was standing within 20 feet of the shots, which dislodged about 5 tons of stone. Deceased was using a 40lb. crowbar to lever a stone off the quarry face, 50 feet above the ground level. He was standing on a ledge of rock about 3 feet 6 inches wide. When he put his weight on the bar the stone splintered and liberated the bar and he overbalanced and fell to the bottom of the quarry.
