- Deceased had finished his work for the day and in order to reach the winding-shaft, was descending a staple pit 15yds in depth, by means of a nearly vertical iron ladder. He wore clogs, the iron tip or rim originally on the sole one of which was the wooden sole worn smooth and curved upwards at the toe. He had got some distance down the ladder, when apparently his foot slipped off the round iron rung, and he fell to the bottom of the staple, landing upon the top frame of the drop cage and sustaining injuries to which he succumbed on the following morning. The ladder was the only means of access to the upper seam, and deceased had travelled by it daily for two months.
