A shaft already sunk to the Plessey seam was being sunk further to the Harvey seam. At the Plessey seam there a scaffold across the shaft fitted with doors through which the sinking kibble passed. Deceased's duty was to open and shut these doors as occasion required and while attempting to do so he fell down the shaft a distance of 80 feet.
