- Deceased was employed to lead the pony only. A man did the coupling to the tip wagon, any spragging required, and the wagon tipping. Some miners working in an open cut left a partly filled wagon in the face when they left off work, on account of continued heavy rain. The boy had to continue at work to help with wagons from inside the mine, and when not actually working had to wait with his pony near the open cut. He was found under the wagon which had been left in the face of the cut, some 20 yards away. The pony was found a long way off with the chain and hook trailing on the ground. The wagon could not have run to where it was found without assistance. It is assumed that he drew the wagon out with his pony, meaning to practice putting drags in. He had not secured the box of the wagon and it swung round and caused the wagon to topple over. He had no right whatever to touch the wagon and his death was the result of his own improper conduct.
