Deceased had just commenced his work in the back shift on a baff Saturday in a cross-cut in the Queen seam, which is 3 feet 4 inches thick and overlaid by 1 foot of ramble. His brother, with was his marrow, had fired a shot on the right side just before he left and warned deceased that the stone was not good. Deceased had just set a prop and plank close to the face when the roof began to work and his cross marrow who was near shouted to him to jump and he did so but failed to get clear and he was caught the prop he bed just set and some other timber being canted out. The roof was not good, and two parallel slips crossed the place diagonally the stone falling between them. The fore shift deputy had examined the place before the men started and was in again at 4am., when he ended a plank. There was a good supply of loose timber near. Deceased was released in a few minutes but his spine was dislocated. He was taken to Newcastle Infirmary and then brought home. The Local Inspectors examined the place and indicated in their report that they thought it would have been safer to take the ramble down instead of timbering under it and that the shot may have knocked a prop out which deceased was resetting.
