- The deceased and his mate were bringing tubs of dirt along a road on which the gradient at one point had all average fall of 1 in 18 for about 20 yards. They had been in the habit of bringing the tubs out in turns to a certain point, the other man going out before and waiting at the point, and a scotch was then put in and both men would go to the rear of the tub. On the present occasion the deceased went out first to wait, but apparently went too far, and his mate went past the usual stopping point with the result that the tub got amain and met deceased as he was returning, and he was crushed against the side.
