- Deceased had brought a tram of rubbish out from a heading, and stopped it at a stall parting in order to arrange the points. When he told his horse to go on, it pulled, but did not move the tram. Deceased, thinking that there was something on the rail, crossed over the gun to see, and when recrossing, the horse started on, and he fell under the tram. The horse was said to be a quiet one.
