Deceased and his butty went back to the tumbling-place to assist the haulier to tumble an empty tram, so as to allow the full tram to be taken out. Deceased stood behind the tram and his mate was told to put two sprags in the wheels. Owing to a misunderstanding between the men, the horse was unhitched before the latter had time to put the sprags in. The train ran back, overpowered deceased and ran over him. The road dipped 5.5ins per yard. His spine was fractured, and he died on July 1st.
