Deceased was filling a tub with debris in the extension of the main dip in the Bullhurst seam, when a piece of overhanging coal fell from the side and crushed him against the side of the tub. He died on the following day. The overhanging coal had been tested by sounding, and was considered to be safe. It should either have been pulled down or supported by sprags.
