- He and his partner were working in a very old gunniss from which they had run the bulk of the deads two days previously. Owing to the shape of the gunniss a part of the deads was left lying in a corner on a sloping block of ground. Immediately before the accident a long iron bar had been handed to him by his partner, who was standing under cover in a level about 10 feet below. There was not sufficient evidence to show whether he disturbed the pile of deads on the sloping block of ground above mentioned with the bar, or whether some ground fell and disturbed it. It, however, came away and he was partly buried in the restricted space from which he was working, and fatally injured.
