- He was engaged enlarging refuge holes on all engine plane, and in one there was a slab of stone in the goaf which he had attempted to get down, by wedging and his pick, several times without success. He then told the driver to bring him a bar from a lading about 700 yards away. Before the driver returned be was found under the stone which had fallen, quite dead. His hammer was also lying under the stone in such a position as suggested that he had been hitting the stone at the back of the hole in order to break it. There was a slip at one side which he would see before the stone fell. He was evidently tempted while waiting for the bar to use the hammer and was deceived by the stone falling sooner than he expected.
