While standing in an opening in the clay seams, 6 yards by 5 yards by 8.5ft high, waiting for a tub which was being filled for him to take out, deceased was struck on the head by a piece of clay and ironstone which fell from the side hear the roof. His skull was fractured and he died at once. The opening was well timbered, and the sides which had been examined shortly before the accident, were considered strong and safe.
