- Fall of ground near the face of a level which his comrades were driving end in which he was loading and tramming the debris away. The accident occurred shortly after the resumption of work after a round of holes had been fired in disturbed or soft ground. The men driving the level were the responsible persons for examining the place and they failed to do so properly but on technical grounds as regards proofs they could not be proceeded against. The case was, at my request, referred to a solicitor, but he found that there was not sufficient probability of getting a conviction to make it advisable to carry it into Court and under the circumstances I reluctantly had to agree with him.
