Along with another man he had been working near the upcast shaft and at breakfast time instead of going the proper way, he attempted to pass between two empty wagons, which were 4 feet apart when they suddenly closed owing to some behind them being lowered and he was caught between them and fatally injured. The wagon-lowerer said as soon as he saw the deceased go between the wagons he shouted to him to keep clear but the wagons closed before he could stop them.
