- The clay face at which the deceased was at work contained beds of stratified shale. Two days prior to the accident a shot had dislodged a large quantity of clay. Blocks of shale were embedded in the soft clay. The deceased, who was working alone, had boon filling the loose clay from under one of the blocks until a portion of it fell away, slid 9 feet down the loose clay, and caught and pushed him against an iron tub which he had filled. The blocks of shale ought to have boon worked down from above and not by undermining.
