- Deceased was preparing to build a pack at a point where a gate was being turned off a cross-gate, and he knocked out a prop from under the roof of the pack-hole causing a fall of stone which fatally injured him. No timber was displaced by the fall. In contravention of Section 49 of the Coal Mines Act deceased was working in a place where the roof deceased was working in a place where the roof was not made secure, the specified distance for setting supports under Section 10 was exceeded, and a hammer was used to withdraw the prop instead of a sylvester, which was provided. A deputy inspected the place two hours before the accident and reported all in order.
