He was on his way to the stables, at the termination of the day shift, with his pony, when he was overtaken by another pony under the charge of a driver, who, it was alleged was trying to drive past Cattell. Cattell was kicked on the head by this pony and received fatal injuries. The road where the accident occurred was 7 feet 6 inches, wide by 6 feet high.
