He was engaged in rebrushing a horse road, the roof of which was much disturbed and broken by the workings on the low side of it and also by the workings in seams above it. At the time of the accident he was preparing to set some timber when a piece of the roof fell and killed him. The fall displaced some timber previously set by him.
